Know the Law & What Misdemeanors Mean to Your Record

From our office in Martinsburg, West Virginia, B. Craig Manford, Attorney at Law, meets with clients who have had run-ins with the law. To people who are unaware of the extent of misdemeanor criminal law, it is important to learn that there are four classes of misdemeanor crimes in West Virginia, two of which have penalties that include jail time. Examples of these include such things as a first DUI offense, possession of marijuana, and minor forms of assault.

CLASS 1 misdemeanors carry a maximum sentence of 12 months in a county jail and a fine of $2,500.

CLASS 2 can give you six months in the county jail with a fine of $1,000.

CLASS 3 and CLASS 4 usually do not include a jail sentence, but you face penalty fines of $500 or $250, respectively.

Misdemeanor offenses and their penalties may be subject to change over time. An example of this would be the allowance in recent years in certain states for medical marijuana use. If you face other criminal charges in addition to the misdemeanor, such as a weapons charge, be certain to review all the details with B. Craig Manford, so you know what to expect.
